Terms of Service
Last updated: 16 September 2026
These Terms of Service ("Terms") govern the contract between Shazark S.r.l. ("tapphost", "we", "us") — VAT/P.IVA IT12620720966, REA 2673165, registered office Corso Buenos Aires 77, 20124 Milano (MI), Italy — and you ("Customer") for the services offered at tapphost.com. By placing an order you accept these Terms.
1. Services
tapphost provides web hosting, domain registration, AI agents and automations, and related marketing services ("Services"), as described on the website and in the order you place. Technical specifications, resources and features are those indicated for the plan you select at the time of purchase.
2. Account & eligibility
You must provide accurate, complete and current registration and billing information, including a valid VAT number or Codice Fiscale where legally required for invoicing. You are responsible for keeping your login credentials confidential and for all activity under your account.
To protect your account, sign-in sessions expire after a period of inactivity, changing your password ends the sessions open on your other devices, and before the most sensitive actions (for example DNS changes, domain transfer codes, access to the control panel) we ask you to confirm your password. If you invite other users to manage your account, you are responsible for the permissions you grant them; the client area on the site is reserved for the account holder and invited users with the required permissions, while other users use the billing portal with the permissions assigned to them; joining the affiliate programme and payout requests are reserved to the account holder.
3. Orders, prices and taxes
Prices are shown on the website and in your cart at the time of order, in Euro, and — unless otherwise stated — exclusive of VAT, which is added where applicable. For Italian VAT-registered customers, invoices are issued electronically through the Italian Exchange System (SDI) using the SDI recipient code or PEC you provide. A binding contract is formed when we confirm your order and/or issue the corresponding invoice.
4. Payment, billing cycle and renewals
Services are billed in advance for the billing cycle you choose (e.g. annually). Payment is processed by our payment providers (Stripe, Stripe SEPA, PayPal). Unless you cancel before the renewal date, subscriptions and domains renew automatically for the same period at the then-current price; we send a renewal invoice in advance. You can disable auto-renewal or cancel from your client area or by contacting us. Website Projects and Guardian are primarily governed by the special rules in articles 7 and 8.
5. Domain names
Domain registrations are subject to the rules of the competent Registry and Registrar and to ICANN policies (and, for .it, the Registro .it rules). You are responsible for providing accurate registrant data. Once a domain is registered, the registration fee is non-refundable, as the service has been fully performed.
6. Free migration & setup
Where offered, we migrate your existing site to tapphost at no additional charge, on a best-effort basis. You are responsible for holding a backup of your data before any migration.
7. Website Project (One, Pro, Business)
7.1 Subject and price. The "Website Project" covers the analysis, design, copywriting, graphics, build and launch of a website according to the tier purchased, together with hosting, email accounts on the Customer's domain and the SSL certificate. The price consists of a one-off setup fee and a fee payable for 12 months, in 12 monthly, 2 six-monthly or 1 yearly instalment as chosen by the Customer when ordering. The domain is not included and is billed separately.
7.2 Term. The contract runs for 12 months starting on the date the service is activated, that is the date on which it shows as "Active" in the client area, regardless of when the website is published and of any delay by the Customer in supplying material.
7.3 Nature of the instalments. The website is built and delivered in the first weeks of the contract, while the price is spread over 12 months. The instalments are therefore the deferred payment of work already performed and remain due in full for all 12 months, including where the Customer cancels early, does not use the website, or asks for it to be taken down.
7.4 Cancellation and expiry. The Customer may cancel at any time by writing to info@tapphost.com or from the client area: cancellation takes effect at the end of the current 12-month term and gives no right to a refund or reduction of the instalments for the period already started. The consumer's mandatory rights under art. 10 are unaffected.
7.5 After the 12 months. On expiry the Project fee ends and does not renew. The website stays where it is, with the access the Customer already holds, and the service automatically continues as hosting only at the corresponding tier and the list price then in force, renewing yearly, or as Guardian if the Customer chooses it (art. 8). The Customer may also cancel that continuation under the ordinary rules of art. 4.
7.6 Customer's obligations and material. The Customer undertakes to supply, within 30 days of activation, the material needed (copy or the information to write it, logo, images, contact details, access to third-party services) and to answer our requests within a reasonable time. If after 30 days the material is still incomplete we proceed with the information available and the fees remain due: a delay in supplying material neither suspends nor extends the term. Work already prepared remains available to the Customer.
7.7 Revisions and approval. The revisions stated for the tier purchased are included (one for One, two for Pro and Business). Further revisions, changes of direction requested after approval, and work not included are quoted separately and accepted in writing before being carried out. If the Customer raises no comments within 10 working days of a draft or revision being sent, it is deemed approved.
7.8 Material supplied by the Customer. The Customer warrants that it holds all rights to the copy, images, trade marks, logos and other material it supplies or asks us to publish, and indemnifies us against any third-party claim in that respect. We may decline to publish material that appears to infringe the rights of others or to be unlawful.
7.9 Delivery. The website is deemed delivered on publication online; on delivery we provide a measurement of page speed. Delivery times shown on the site are indicative and run from receipt of the complete material.
7.10 Included changes. The fee includes one change a month, up to 30 minutes of work, which cannot be carried over to later months or converted into money. The "Modifiche Plus" option, if taken, adds three changes a month on the same conditions and follows the term and expiry of the Project.
7.11 Access and ownership. From activation the Customer holds full access to their own space (control panel, email, database, backups). The content of the website is and remains the Customer's. Where payment is not made we may suspend the service under art. 14: suspension does not extinguish or reduce the amounts due.
7.12 Non-payment. If an instalment is unpaid the service is suspended 7 days after the due date, after a reminder. Unpaid amounts remain due; in dealings with parties other than consumers, late-payment interest under Italian Legislative Decree 231/2002 applies.
7.13 What is not included. Unless otherwise agreed in writing, the following are not included: the domain name; e-commerce with cart and payments; members' areas and user registration; integrations with management software or external systems; writing blog articles; stock photographs beyond the number stated for the tier; third-party software or content licences. That work is done to measure, against a quote.
7.14 Contact form. The website's contact form uses a service provided by tapphost. If the Customer moves the website to another provider, the form must be replaced or reconfigured at the Customer's own care.
7.15 No guarantee of results. We undertake to carry out the work described (pages, content, measured speed, structured data, crawler access). We do not guarantee any position in Google or other search results, nor that AI assistants will cite the site, nor any number of visits or enquiries: these depend on third parties and on factors outside our control.
7.16 Specific approval. Under arts. 1341 and 1342 of the Italian Civil Code, the Customer specifically approves clauses 7.2 (term running from activation), 7.3 (instalments due for the whole term), 7.4 (cancellation effective at expiry and no refunds), 7.6 (fees due even if material is missing), 7.7 (tacit approval of drafts), 7.12 (suspension for non-payment), 7.13 (exclusions) and 7.15 (no guarantee of results), by ticking the dedicated box, separate from general acceptance, before completing the order.
8. Guardian (maintenance from month 13)
8.1 What it is. Guardian is the optional maintenance plan that may replace hosting-only when a Website Project expires. It includes: hosting, email accounts on the Customer's domain and an always-valid SSL certificate; website updates; daily backups with a quarterly restore test; malware scanning on the server; one change a month of up to 30 minutes, not carried over; a report every three months.
8.2 Term and cancellation. Guardian is billed on a monthly cycle. The Customer may switch it on and off at any time: cancellation takes effect from the following month, that is at the end of the month already invoiced, with no refund of the current month. On cancellation the service continues as hosting only at the corresponding tier and the list price then in force.
8.3 What it does not include. Guardian does not include continuous uptime monitoring with alerts, the domain name, development of new features or pages, editorial content, or third-party licences. Articles 13 (service levels, maintenance and backups) and 7.15 (no guarantee of results) otherwise apply.
9. 30-day money-back guarantee
New hosting plans include a 30-day money-back guarantee: if you are not satisfied, contact us within 30 days of activation for a refund of the hosting fee. The guarantee does not cover domain registrations/renewals, setup fees, add-ons already provided, or third-party costs. The guarantee does not apply to Website Projects (art. 7) or to Guardian (art. 8).
10. Right of withdrawal (consumers)
If you are a consumer, you generally have 14 days to withdraw from a distance contract under the Italian Consumer Code (D.Lgs. 206/2005). However, by requesting immediate activation of the Services and expressly consenting at checkout, you acknowledge that: (a) for digital services fully performed, the right of withdrawal is lost once performance has begun with your consent; and (b) domain registrations are excluded from withdrawal. Where withdrawal still applies, contact info@tapphost.com.
11. Acceptable use
You must not use the Services to store or transmit unlawful, infringing, malicious or abusive content, to send spam, to compromise security, or in any way that harms tapphost, its infrastructure or third parties. We may suspend Services in case of serious or repeated violations, or where required to protect the platform.
12. AI features — disclaimer
AI agents and automations generate outputs automatically and may occasionally be inaccurate or incomplete. They are provided "as is"; you are responsible for reviewing and for how you use their output. AI features are not a substitute for professional (legal, medical, financial) advice.
13. Service levels, maintenance & backups
We target 99.9% monthly uptime but do not guarantee uninterrupted or error-free service. Scheduled maintenance may cause brief interruptions. While we perform backups for continuity, you remain responsible for keeping your own backups.
14. Suspension & termination
Either party may terminate for the future by disabling renewal. We may suspend or terminate Services for non-payment, breach of these Terms, or legal reasons. On termination, your data may be deleted after a reasonable period; export it beforehand.
15. Intellectual property
The tapphost platform, brand and content are owned by Shazark S.r.l. Your content remains yours; you grant us the limited rights necessary to operate the Services on your behalf.
16. Limitation of liability
To the maximum extent permitted by law, our liability for any claim relating to the Services is limited to the amount you paid for the affected Service in the 12 months preceding the event. We are not liable for indirect or consequential damages, loss of profits or loss of data beyond what the law mandates. Nothing limits liability that cannot be limited by law, including consumers' mandatory rights.
17. Data protection
We process personal data as described in our Privacy Policy. Where we act as your data processor for content you host, a Data Processing Agreement is available on request.
18. Changes to the Terms
We may update these Terms; the "Last updated" date reflects the current version. Material changes affecting active services will be communicated in advance, and continued use after they take effect constitutes acceptance.
19. Governing law & disputes
These Terms are governed by Italian law. For consumers, the mandatory jurisdiction is the court of the consumer's place of residence or domicile; for businesses, the exclusive jurisdiction is the court of Santa Maria Capua Vetere. Consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
20. Affiliate programme
Customers can join the affiliate programme for free from the client area. Participation, commissions, payouts and promotion rules are governed by the Affiliate Programme Terms, which supplement these Terms. Purchases made through an affiliate link have the same price and conditions as direct purchases.
